It helps to be precise about where food safety requirements actually come from, since the terms get used loosely. The FDA publishes the Food Code as a science-based model, but it is not federal law. It is guidance offered for states and localities to adopt. FDA’s own adoption tracking confirms that restaurant and retail food oversight is handled at the state and local level, not the federal level, which is why the specific code edition in force, and the exact rules an inspector checks against, vary by jurisdiction.
State and local health departments are the ones who adopt a version of the code, issue permits, run inspections, and hold the legal authority to cite a restaurant for a violation. A formal, written HACCP plan is not a universal requirement for every restaurant. Most quick-serve and full-service kitchens operate under active managerial control instead. A written HACCP plan is typically required when a kitchen runs a specialized, higher-risk process, and the list is more specific than most operators expect.

That last row is why BOHA! Pencil whipping is the industry term for what happens when staff skip the actual check and fill in a log with fabricated readings and approvals, to save time or hide noncompliance. It is usually less a character issue than a tool, workflow, or process one: the check is inconvenient, the shift is short-handed, the log is due, and nobody looks at that page until an inspector does.
This is worth grounding in real numbers rather than intuition. CDC tracks and reports on the causes of foodborne illness outbreaks nationally, and in its review of outbreak data reported from 2014 to 2022, the CDC found that inadequate food temperatures remain a common cause of bacterial outbreaks, with inadequate hot and cold holding appearing again and again among contributing factors. None of that data sets policy on its own, but it explains why the gap between what a log says and what actually happened is not a hypothetical risk.
A paper log cannot tell you whether a number came from a probe or from a pen. A digital check, timestamped and tied to the person who ran it, can.
A log that only notes an out-of-range reading has documented a problem without solving it. The operational goal is to close the loop while the food is still recoverable, which means the response cannot depend on whichever staff member happens to be nearby or how well they remember the standard.
